When he is sentenced next month, a man who pleaded guilty to involuntary manslaughter for fatally force-feeding his husband at the couple’s Rancho San Diego home might face up to four years in jail. Thomas Zupner, 67, was charged with second-degree murder in the death of his 62-year-old husband of 11 years, Blake Synowski, on Sept. 17, 2019.
San Diego Superior Court Judge Robert Amador concluded Monday after a bench trial in El Cajon that the evidence did not support the second-degree murder charge, but was sufficient for an involuntary manslaughter conviction. Zupner later pleaded guilty to the charge of manslaughter.
Sheriff’s deputies arrived at the couple’s home on Explorer Road around 10:15 p.m. that night and discovered the victim unresponsively. At the spot, he was pronounced dead.
According to testimony, Synowski died as a result of an obstruction of his airway and mechanical asphyxia.
During “a violent struggle” in which the defendant pinned Synowski down, prosecutors claimed Zupner shoved food into his wife’s mouth.
Defense counsel Paul Pfingst testified at Zupner’s preliminary hearing that Synowski had a variety of medical conditions and that his client was trying to preserve his husband’s life by feeding him but inadvertently killed him in the process. When Synowski had previously refused to eat, Pfingst stated force-feeding had worked well.
