Bail granted to Tamara Lich
After being jailed for two and a half weeks on mischief charges, Tamara Lich, one of the main organizers of the Freedom Convoy demonstration, was given release.
Superior Court Justice John Johnston said an earlier court made “legal errors” in denying Lich bail on February 22 — he claimed the accusations she faces are on a “lower scale” than other offenses for which she was granted.
“I find that Ms. Lich does require a level of supervision if released,” Johnston said, but that can be “managed” by the surety supervising her bail.
Lich’s detention is “very exceptional,” according to John Carpay, president of the Justice Centre for Constitutional Freedoms, which has represented other convoy participants. She has no previous record and is not charged with a violent crime.
“People accused of drug trafficking, illegal firearms possession, and violent offenses are routinely granted freedom prior to trial,” said Carpay. A Justice Centre news release describes Lich as a “political prisoner.”
Lich will be freed on a $25,000 bond on the condition that she does not protest COVID mandates or use social media, and that she returns to her home in Medicine Hat, Alta.
Lich was arrested and charged with counseling mischief on Feb. 17, the day before police used powers granted by the federal Emergencies Act to remove demonstrators that had clogged downtown Ottawa for three weeks.
Justice Julie Bourgeois of the Ontario Court of Justice had ordered Lich’s detention, causing her lawyer, Diane Magas, to accuse her of bias.
