A home incident in April left 12-year-old Archie Battersbee with catastrophic brain injuries, and since then, his family and doctors have fought in court about how long he should remain on life support.

Tuesday will mark the termination of Archie Battersbee’s life support after the Court of Appeal rejected his parents’ last-ditch request to delay the procedure.
Judges on the Court of Appeal have informed the parents of the 12-year-old that they cannot delay Tuesday at 12 o’clock for the removal of life-sustaining care for their son.
“My conclusion is that, save for granting a short stay until 12 noon tomorrow, the parents’ motion for any further stay is dismissed,” said Sir Andrew McFarlane, who was seated beside Lady Justice King and Lord Justice Moylan.
After losing their legal struggle with Barts Health NHS Trust over his care, Hollie Dance and Paul Battersbee of Southend, Essex, filed a last-ditch application with the UN Committee on the Rights of Persons with Disabilities, which led to the ruling.
The judges rejected requests for authorization to appeal their decision to the Supreme Court.
Now, Archie’s parents can ask the Supreme Court judges to take their request for authorization to immediately appeal into account.
Archie’s Mother Statement
Hollie Dance, Archie’s mother, said she and Paul Battersbee, his father, will file a petition with the UK’s top court.
She said in a statement: “We continue to be shocked and traumatized by the brutality of the UK courts and the hospital trust.
“Our wishes as parents continue to be trampled on and ignored. We do not understand the urgency and rush to end life-support.
“The hospital trust has at no point given us time to come to terms with what has happened.
“This is no way for a compassionate society to treat a family in our situation. We will continue to fight for Archie.”
At the Royal London Hospital in east London, the child’s life support was scheduled to be turned off at 2:00 p.m. today (Monday, August 1) after a High Court judge determined that it was in the child’s best interests and the family’s had exhausted all appeals.
However, the UN committee asked the UK government to “refrain from removing life-preserving medical assistance, including mechanical breathing and artificial nourishment and hydration” for Archie while his case is being looked into in a letter sent on Friday (29 July).
Virtual Hearing
The court will be “complicit” in a “flagrant breach of international law” if the cessation of Mr. Battersbee’s life-sustaining therapy is not delayed, Ms. Dance’s and Mr. Battersbee’s attorneys warned this morning.
On behalf of Health Secretary Steve Barclay, the Government’s legal division then urgently requested the courts to take the committee’s request into consideration on Sunday, July 31.
This morning (1 August), the Court of Appeal had a virtual hearing to evaluate the concerns, and it issued its decision just after 4 pm.
Judges in an appeals court had concluded that physicians could legally stop giving the 12-year-old, who had suffered “catastrophic” brain damage almost four months earlier, life support.
Archie’s current treatment does not cause him any pain or anxiety, according to the High Court’s ruling that he cannot feel pain.
Regardless of any brain damage, injury to his spinal cord could prohibit him from being able to breathe on his own.
